SAN JOSE – Rise Law Firm Partner Eliot Rushovich was interviewed and quoted today in the widely read entertainment news blog Nicki Swift regarding the admissibility of evidence related to the upcoming trial of former executive and founder Elizabeth Holmes.
In the article, Rushovich is quoted as noting that “[i]f the judge allows evidence of Elizabeth Holmes’ luxurious lifestyle with ‘private jets, five-star hotels, [and] designer clothes’ to be heard, it would benefit the prosecutors ‘who claim her high compensation and business perks reflect evidence of motive to defraud. Her defense, on the other hand,” Rushovich notes “‘will argue that she was convinced her product was going to work and was simply using puffery in her communications to investors’ to appeal to pathos.”
